THIS JOINT VENTURE AGREEMENT (the "Agreement"), made and entered into as of this legally binding date stamped document by and between the CSM AZ CLASH Baseball and its Board of Directors and the specific affiliate organization as outlined in the aforementioned registration application attached to this document.

GENERAL PROVISIONS

1.01 Business Purpose. The business of the Joint Venture shall be as follows:

To build the business of two or more organizations and utilize the strengths and networks to build the best opportunities for players in the states of Arizona, California, Washington, Idaho, Oregon, Montana, Wyoming, Nevada, Western Texas, Colorado, Utah, and New Mexico.

1.02 Term of the Agreement. This Joint Venture shall commence on the date first above written and shall continue in existence until terminated, liquidated, or dissolved by law or as hereinafter provided.


GENERAL DEFINITIONS

The following comprise the general definitions of terms utilized in this Agreement:

2.01 Affiliate. An Affiliate of an entity is a person that, directly or indirectly through one or more intermediaries, controls, is controlled by or is under common control of such entity.

2.02 Capital Contribution(s). The capital contribution to the Joint Venture actually made by the parties, including property, cash and any additional capital contributions made.

2.03 Profits and Losses. Any income or loss of the Partnership for federal income tax purposes determined by the Partnership's fiscal year, including, without limitation, each item of Partnership income, gain, loss or deduction.

CSM AZ CLASH Baseball POSITIONING STATEMENT:

CSM AZ CLASH Baseball provides an opportunity to increase the number of players who reach the college and professional ranks through national-level competition and superior coaching with an emphasis on skill development and exposure.

CSM AZ CLASH Baseball is a professional group of collegiate players and coaches who have come together and dedicated themselves to training younger players who have the desire and determination to bring their game to the next level. Just come to a CSM AZ CLASH Baseball Training session and you will feel the commitment, your will hear the training and you will experience the game in ways that few parents and players between 8 and 18 ever have a chance to.
Accordingly, all CSM AZ CLASH Baseball players (from 7-18) receive expert skills training and coaching, but more importantly, every player receives advanced training in baseball strategy and gamesmanship. Specifically, High School Players and Coaches train 13 and under teams, College Players and Coaches train 16 and under teams, and College and Professional Players and Coaches train 18 and under team.

There is no other organization in CSM AZ CLASH Baseball who can provide the level of baseball training experience and know-how for young players aspiring to play at the high school and collegiate level.

Our on-staff, 40+ collegiate players and coaches commitment includes:

Local and National-level game and tournament competition
Superior coaching (2-4 specific position coaches on each team) with an emphasis on skill development
Collegiate Scout exposure (135 Scholarships in 7 years)

To help accomplish this mission, it is expected that CSM AZ CLASH Baseball Coaches’ will:
-Act in a professional manner and be a positive role model for student/athletes at all times.
-Run their teams with Discipline and Class and demand these qualities from their student/athletes.
-Know and follow all NCAA, AIA, and Pro rules on the field and know and follow our team guidelines off
the field. No high school player may receive any instruction during the high school spring season.
-Foster the life skills of Discipline, Honesty, Respect, Hard Work, Teamwork, Etc. in their athletes.
-Place the emotional and physical well-being of their student/athletes above their personal desire to win.

If your information and profile is not complete please contact your Director to get your profile form for you to complete. Your head coach will update the website with that information immediately.

Schedules –
All practice and game schedules and pitching rotations must be posted on line by the coaching staff in at least a month ahead of time. See the tab called event calendar to place your pitching rotations and see the game schedules tab to input your practices and games.

Parent Meeting and Communication –
Like it or not, parents are an essential part of any successful athletic program. As a coach you certainly need their support for our program. There are a number of potential positive contributions which they can make. However, an even greater potential exists for harm to our program’s success if you do not channel parental involvement in a direction that will serve our program instead of hamper it.
Communication is a major key to success in this whole realm. Coaches who communicate well with parents will be able to involve them as partners throughout the season. Holding a parent orientation meeting allows coaches to meet parents and suggest ways that parents can help the team. At this meeting, important information should be shared, such as the coach’s philosophy, how the season will be structured expectations of the players and parents, and the gathering of necessary medical information, which will always be on file on our website.
Be sure to organize your meeting at a convenient time for the majority of your athlete’s parents to attend. Contact parents in person, by telephone, or mail them a letter urging their attendance, and provide them with a short agenda of the scheduled meeting. Below is a suggested list of agenda topics: We will also have a program wide meeting.
Goals for the season.
Dangers and/or injury risks’.
Emergency procedures that will be followed.
Special equipment needs that are not provided.
Athlete’s responsibility.
Channels of communication.
A current, early and often season schedule of games and practices.
Question/answer period for parents.
Make sure medical information can be accessed or you will need to make physical copies and keep them in your car at all times.
Finally, remember what you have to say is very important and do not apologize for taking the parents’ time. Give yourself plenty of time in scheduling this meeting so you don’t feel rushed to end on at a predetermined time. Taking time now to inform the parents and answer any of their questions can prevent problems later in the season.
Through effective communication and organization, most conflicts with parents can be avoided. Establishing regular communication with parents such as periodic telephone calls or letters can help prevent conflicts. Listen to the feedback parents provide and then you decide whether it is realistic or helpful for the athletes and the team. Being able to listen to them is the point.
The coaches of CSM AZ CLASH Baseball understand the importance of parental interest, involvement, and communication. One of our major goals is to strive for open communication and positive interaction between parents and coaches. It is the coach’s responsibility to meet with the parents of his entire program prior to the start of the season. Areas that should be covered include rules, expectations of the players and playing time for athletes. Parents are encouraged to contact the Coaches first and a Director last. Their will be fines for excessive parent calls to Directors.

Policies and Protocol –
All coaches must attend all CSM AZ CLASH Baseball activities as part of their commitment to the program and as part of their salaries. This includes camps, dinners, fundraisers, clinics, etc.

Banquets –
We will have a big banquet program wide, but you may have an individual one for your own team.

Budget –
At the conclusion of each season, coaches must meet with the director of coaching to inventory equipment and uniforms and to budget for the following year. Any missing items will be taken out of your last pay check. Charge your players for missing items as they occur so you are not billed for them. ALL CONTRACTORS, COACHES, TEAM AFFILIATES, DIRECTORS OF THE CSM Rawlings Prospects ORGANIZATION WILL BE PAID BY A PERSONALLY SUBMITTED INVOICE AT THE END OF EACH MONTH AS APPROVED BY THE BOARD AND DELIVERED BY THE C.F.O.
Profits and Losses. Commencing on the date hereof and ending on the termination of the business of the Joint Venture, all profits, losses and other allocations to the Joint Venture shall be allocated as follows at the conclusion of each fiscal year: New territory Director of Operations will receive 51% of new business. Coaches to receive $25 per event for 90 days than reevaluated to additional per event fees as agreed by the Director of Coaching.

Conduct –
Coaches are expected to conduct themselves in the same professional manner as stated in the team guidelines.

Conflicts of two events –
You may have conflicts with other sports; athletes who miss as long as they give you 24 hour notice shall not be punished. Make sure you pan your schedule a month ahead of time so you are never short players. Make arrangements with the older or younger teams to ensure you have enough guys at your tournament.

Criticism of Officials –
Coaches may not criticize officials/coaches/players either personally or to the media or to the parents. You may be removed from a game no more than once a year or fines, suspension or removal from our program will take place. Just go ask the umpire nicely; “I just cam out to see what you saw.”

Eligibility –
May 1 for little league, premier and older age groups, does not matter. Although no player or coach can play or coach without signing up online, this is our waiver of liability forms.

Finishing Tournaments or Games/Quitting-
Any student/athlete who quits a team forfeits all money invested. If any money is owed the difference is disbursed amongst the rest of the team uniforms, jacket and playbook must also be collected by the coach at the end of the season.
Coaches cannot pull their team from a contest or tournament before it concludes, ever!

Hiring Coaches and Players –
Always recruit good players and coaches, make contacts and start your won contact list, no matter what age or school. We as an organization need to continue to grow and recruit players at all age levels.

Meal Money –
Typically it is $100 per trip, and you are responsible for any over that amount.

Overnight Trips – You will be given meal money, rental vans, and hotel budgets. Dates and times are very specific and all listed on your itinerary under the travel itinerary tab on the welcome page. On the road adhere to these times and be willing to be flexible. Any overage of charges based on the itinerary, including rollaways, not adhering to the rental van time return or late checkouts etc. will be deducted from your check that is paid as the quarterly fees are paid from your players.

Camps –
Be prepared to work one camp a year as part of your coaching salary.

Playing Time –
Coaches are encouraged to make every effort to give athletes a fair amount of playing time in games. This applies to all levels. At Bats should be disbursed evenly. Pitchers at the higher levels are exceptions. I don’t want any parent phone calls regarding playing time. Equal it all out in the end and as the season progresses.

Practices –
If you can get a free field get one. If you can’t Phoenix College is $50 and hour and comes out of your field rental budget. Each level varies. You must book PC in a month in advance to lock in the field. Do not call a practice without at least a two week to a month warning to a parent.

Clinics –
As we continue to offer free clinics to get more CSM AZ CLASH Baseball players you will be required to help run them as part of your coaching salary.

Rosters –
All coaches are responsible to update their own rosters as well as their profile information for the players. Click on the Teams tab and then scroll to your team and then click on Players to update all information. Don’t forget to push save at the bottom of the page and not the enter button. This also includes your stats, game scores, video streams and fines will be assessed if your team is not updated on a weekly basis.

Stats –
You may upload your stats in any manner. Palm Pilots are easiest or manual works as well. You can even have your kids do it individually. The id is the age group, for example, 18u, and the password is ‘stats’.You are responsible for making sure your parents have access to this.

Season Evaluations –
All coaches are required to conduct a pre-evaluation, and a season communication meeting and a post evaluation meeting to each player for each season you play. They are always easiest on road trips.

Schedule Changes, officials, facilities –
Coaches’ are not permitted at any time to make schedule changes without the consent of a Director and is responsible for contacting umpires, facilities, coaches, and parents, in at least a 72 hours advanced notice or fines will be implemented. If you planned your month out and brought up younger players you should never have this problem. It makes for a bad situation for everyone and we lose money for every game cancelled.

Substitute Coverage –
No non player of CSM AZ CLASH Baseball or non coach of CSM AZ CLASH Baseball can cover any event. No registration no play or coach.

Photographs –
Team and individual photographs are your responsibility and must be updated on the website. Click on upload files tab and make sure the scroll down box says pictures. Then go to players and fill in your file.

Stream Line Videos, recruiting –
Only juniors, seniors, and collegiate coaches’ need to be in conjunction with Coach Shane Hesse to ensure each player has a video of himself catching, running, and throwing for any potential scout to be able to see him on our website.

Tournaments –
Bonuses are always given for big tournament wins as long as playing time was still even, I understand the championship game you need your best nine on the field.

Transportation –
Set up a roster for parents who live near each other can car pool. If that can’t happen then one of the coaches must go pick up the kid and make arrangements for the parent to pick him up after the event. Don’t ever have a kid not attend something because of a ride issue. Tell the parents not to abuse this but this is a key responsibility for all CSM Rawlings Prospects coaches no matter how far he lives away.

Tryouts –
Our tryouts never end, if any player contacts you and wants to tryout, schedule an individual workout and let a director know what you have planned, we want to add players as they present themselves, especially at the lower levels.

Uniforms –
Universal Athletics handles all uniform and equipment needs. Kids pay for their uniforms; you have a strict budget to pay for the equipment and must channel funds through Coach Justin Hesse. You can not process anything to then directly; I must have my stamp of approval on everything.

Hazing –
Not acceptable. Don’t do it, ever.

Recruiting –
Utilize your contact, parents and players to continually bring guys aboard our program.

Supervision –
Coaches’ must not leave athletes unsupervised before, during, or after games or practices. The coach is not to leave until all athletes have left campus or the practice site.

Transportation on the Road –
The 21 or older budget is our car rental corporate account, all you need to do is show your license and make sure you bring the car back at the same time you checked it out. If you need to delay the checkout to return it later than please do so. Please bring the rental back early to save an extra day rental fee so the coaches’ do not get charged overage. The extra charges are taken off your pay check.

Hotel info on the Road –
Hotel info is set the same way as the rental car info above.

Calendar –
The event calendar tab on the website must include any off field activities and pitching rotations. This is viewed all the time and must be updated as events are added for your program.

Scheduling Practices –
Keep in mind, no last minute practices, and field rental fee at PC is $50 and must be advanced booked a month in advance.

Conditioning –
12U and under do not condition, ever!

Taxes –
You are responsible for your own taxes and are expected to report your own earnings.

Payment –
Paychecks are written from our accountant only and are distributed each quarter as the kids pay their fees.

Waiver, Non Compete, Non Disclosure
You may not leave our team/organization and start a team/organization of your own and/or take any of CSM AZ CLASH Baseball players to play for another said team. Furthermore as CSM AZ CLASH Baseball will be building the newly acquired affiliate organization, at no point can you decide to break into your own organization utilizing any of our processes, coaches, players, parents, ideas etc. whether they came originally or not. Court sanctions will be imposed as a one year noncompete and nondisclosure clause and contractual binding agreement for self or forced removal from our program as governed by the Laws of Arizona Court of Law and the Law Firm that represents The CSM AZ CLASH Baseball Organization.
The directors may add or change these above and below guidelines at any point to fit the needs to better our program. .
You occupy a trusted position within The CSM Rawlings Prospects organization. You have access to confidential and proprietary information, such as trade secrets, cost and price data, internal corporate planning, methods of operation, know how, practices, procedures, and techniques.
Accordingly, on behalf of the "The CSM AZ CLASH Baseball ", and any affiliated business organization, I want to explain certain basic agreements with all individuals who are employed by "CSM AZ CLASH Baseball" that have always been understood, but which have not always been stated expressly in writing. In order to be consistent with similar agreements made with other management employees of "Your Firm, Person or Affiliate Team", CSM AZ CLASH Baseball requests, and you concur in, the following acknowledgments and agreements.
As you know “CSM AZ CLASH Baseball” has invested a substantial amount of time and money in the development of its client/player lists and operation of its baseball instruction, as well as our practices and procedures. In addition, you are aware that the discussions, writings, and other communications among executive and management employees of "CSM AZ CLASH Baseball" concerning its present business and future endeavors contain confidential and proprietary information that is extremely valuable to “The CSM AZ CLASH Baseball” and not generally known to the public, nor to the business community or other baseball organizations and/or companies.
Therefore, based on all the foregoing, you hereby agree that during your employment by “CSM AZ CLASH Baseball”, and for a period of twelve (12) months after termination of your employment, you will keep all information described herein in strict confidence and not disclose it to any person outside of “THE CSM AZ CLASH Baseball” without the prior written consent of “CSM AZ CLASH Baseball” Executive Director, which consent may be withheld for any reason whatsoever.
Furthermore, during the period of your employment, and for a period of twelve (12) months thereafter, you hereby agree that you will not directly or indirectly engage in competition in any way with “CSM AZ CLASH Baseball” by being associated with any baseball organization or other business that may compete with “CSM AZ CLASH Baseball” in any area that “CSM AZ CLASH Baseball” may be engaged in business or any area for which “CSM AZ CLASH Baseball” has submitted proposals for business. The term "competition" as used in the foregoing shall include, but not be limited to, attempts to divert clients, players, sponsors or accounts from “The CSM AZ CLASH Baseball” and attempts to induce employees of “The CSM AZ CLASH Baseball” to terminate their employment. You hereby agree that “The CSM AZ CLASH Baseball” shall be entitled to enforce the provisions of this Memorandum by any legal means. Such means shall include that right to enjoin you by legal process from violating the provisions hereof.

CSM AZ CLASH Baseball, AZ CLASH, BASEBALL, CSM VOLLEYBALL, AND CSM SOFTBALL/ARIZONA BASEBALL ACADEMY(AZBA)/AMERICA AMATUER BASEBALL CONGRESS(AABC)/AMERICA'S BASEBALL CAMPS/PSWL NATIONAL BASEBALL CONGRESS/PREMIER BASEBALL/ANY AFFILIATE/SUNCATS SOFTBALL

Coaches, Recruitier, Director, Team Affiliate Contract

All must read and AGREE to the following information:

Your electronic or written signature verifies that, the coach agrees to the following as well as the above information in the contract:
NO player can receive compensation for playing and further agrees to abide by the rules of the League, the Association, Triple Crown, Super Series, Premier Baseball, USA Junior Olympics, and the AABC and all other affiliates or nonaffiliated of the CLASH Baseball AND softball program. Only 20 players can be rostered for most tournaments, rosters vary depending on age. In consideration of acceptance of this contract; I hereby for myself, my heirs, executors and administrators, waive and release any and all rights and claims for damages I may have against the AABC/AZBA/AMERICA'S BASEBALL CAMPS/CSM AZ CLASH Baseball BASEBALL and Softball /ANY CSM AZ CLASH Baseball AFFILIATES and all members associated including the coaching staff, managers, volunteers or former or current players for any and all injuries suffered by me in any given activity, game or practice. If a coach leaves our organization at any time and leaves the CSM AZ CLASH Baseball short of funds that team will divide the cost amongst the current players. You will receive compensation and be responsible for filing your own taxes and claim it as your responsibility and have been said such that. Any CSM AZ CLASH Baseball equipment given must be returned in order to avoid a court juncture to retrieve the funds as well as a final paycheck when your season is complete. The hotel, rental vans, coaches expenses and reservations will be provided in a travel costs package and must be paid prior to the trip by players and the set fees can not be altered or changed by any coach, if the fees are raised due to poor judgment or missing a deadline or any other reason the overage of fees will be taken out of your pay check. These financial obligations are subject to change by the executive director at any time based on his discretion. YOU WILL ALSO BE GIVEN A DIVISION ONE TYPE PLAYBOOK - ALL BOOKS MUST BE RETURNED AT THE END OF THE SEASON AND IF THIS BOOK IS NOT RETURNED IN A MANNER THAT THE OWNER DEAMS NOT SUITABLE TO GIVE TO ANOTHER PLAYER, YOU WILL BE BILLED $100 so make sure you charge the player for these fees. This also applies to any item or piece of equipment that is given to you at the beginning of the season. If your team breaks or loses it you must cover the expenses yourself by the players on the team or you will be charged for it out of your paycheck. I accept and understand the terms of this contract by reading this contract and by finishing registration.

2.Host 2 skills camps each month at location of choice to develop multiple positions for players
and expand marketability for high school or college.
3.8-13u focus is to prepare them and refine skills to make varsity as a Frosh or Sophomore
4.13-18u focus is to prepare them and refine skills to make and play in a collegiate/pro setting.

1)15-18u $200.00 a year per player for club fee(paid in advance) and one free showcase put on by CSM AZ CLASH Baseball.
2)8-14u $125.00 a year per player for club fee(paid in advance) and one free 3 day summer camp. (all coaches participate)
3)CSM AZ CLASH Baseball affiliate club must order from (Universal Athletics) U.A. will have an online form and spirit wear order form made for your club. Front of Jersey will have your name and your logo on front of hat. Your club must have AZ CLASH Baseball on the sleeve of your uniforms and CLASH on back of hat. 4)Must play in 1 CSM premier tourney a month and one CSM Premier Championship Tourney a year with a $1000.00 cost.
5)Coaches cannot recruit off of any CSM AZ CLASH Baseball Baseball Affiliate. If a player just shows up at tryouts then (Coaches must call and coordinate with affiliate guy to see if it would be a problem.

7)Winners of the AZ Premier 14u Championships get a birth to American Premier World Series in Joplin, MO. July 6th 2011.
8)CSM AZ CLASH Baseball offers a place for your 14u to go to when they are finished with your organization. CSM Rawlings Prospects affiliates and our exclusive CSM Rawlings Prospects Teams that compete nationally every year at 14u, 15u, 16u, 17u, and 18u.

Goals for your organizations:
-Have two teams at every level A and B Level players.

IN CONSIDERATION of being permitted to participate in any way in any AABC/AZBA OR CSM AZ CLASH Baseball BASEBALL and softball events at any time during the current calendar year (“Activity”) I, for myself, my personal representatives, assigns, heirs, and next of kin:

1. ACKNOWLEDGE, agree, and represent that I understand the nature of Baseball Activities ON AND OFF THE FIELD, and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time that I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.

2. FULLY UNDERSTAND that: (a) BASEBALL ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW;(c) there may be OTHER RISKS AND SOCIAL ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSOBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE the AABC/AZBA/CSM Rawlings Prospects BASEBALL, it’s respective member teams and leagues, coaches, their administrators, directors, agents, officers, members, volunteers, team members, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and leasers of premises on which the Activity takes place, (each considered one of the RELEASEES herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releases, I WILL INDEMNIFY, SAVE, AND HOLE HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

DISSOLUTION

9.01 Events of the Joint Venturers. The Joint Venture shall be dissolved upon the happening of any of the following events:

(a) The adjudication of bankruptcy, filing of a petition pursuant to a Chapter of the Federal Bankruptcy Act, withdrawal, removal or insolvency of either of the parties.

(b) The sale or other disposition, not including an exchange of all, or substantially all, of the Joint Venture assets.

(c) Mutual agreement of the parties.


I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND IT’S TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY CHECKING THE I/WE AGREE BOX(electronic signature) BELOW AND HAVE CHECKED(electonic signature) IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILTY TO THE GREATES EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT AS WELL AS SIGNED IN FRONT OF WHITNESSES THEIR IN OF ONE OR MORE MEMBERS OF THE BOARD OF DIRECTORS OF THE CSM ORGANIZATION... SHANE HESSE, OR JUSTIN HESSE. FURTHERMORE ANDY DEBT OR LOSSES INCURRED BY THE AFFILIATE ORGANIZATION PRIOR TO SIGNING THIS CONTRACT WILL STILL BE THE SOLE RESPONSIBILITY OF THE SAID AFFILIATE ORGANIZATION.

Minor Release
AND I, THE MINOR’S PARENT AND/OR LEGAL GAURDIAN, UNDERSTAND THE NATURE OF BASEBALL ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. I ALSO TESTIFY THAT I AM READING THIS CONTRACT WITH MY PARENT OR GUARDIAN.

By checking the I/We agree box below or signing and dating this contract; I (the player named above) an 18 year old can check the box myself and agree to the contracts/waivers/agreements above; as an under 18 year old player my parents/guardian must check the I/We agree box as such the parents/guardians and minor both accept the terms to the agreement/waiver/contracts above.
